The Wrongful Conviction Of The Criminal Justice System

As defined, a wrongful conviction is a conviction of a person accused of a crime which, in the result of the subsequent investigation, proves erroneous. Persons who are in fact innocent but who have been wrongly convicted by a jury or other court of law. For this reason, wrongful convictions disrupt trust in our justice system, therefore, such convictions undermine public safety by leaving the correct or legitimate positives of the guilty in the community to carry out future offences. With this in mind, one needs to secure the society and/or families of crime victims that are caused by the incorrect or misleading errors that all humankind institutions occasionally make through accidental, unintentional, and through failures in working the system. Moreover, a nine-year-old girl, Christine Jessop was murdered on October 3rd, 1984. Guy Paul Morin, her alongside neighbor was charged for her murder. Thereupon, around 3:32 pm Guy Paul Morin departed for work; however, appeared to have arrived home at 4:14 pm, however, Christine was not at all in the house when the Jessops arrived; therefore, the family assumed there was no need for an urgency to cause an alarm. Ireland ended up pleading guilty of the crime, most likely to have a lesser sentence. The jury deliberated for three days over the decision, most likely because not all of the evidence was consistent. Ireland’s defense had just enough information for a successful case, but the lack of more evidence in his favor and information about other possible suspects lead the jury to make the devastating decision of sentencing him to fifty years in prison (â€Å"The Innocence Project,† n. d.). There were three charges against Ireland: felony murder, first-degree sexual assault, and third-degree burglary. In 1991, Ireland appealed the decision by providing two arguments: that the two witnesses were informants and were being given a $20,000 reward to cover for another man, and that the court prohibited his defense from exhibiting evidence about another possible suspect. Unfortunately, his appeal was denied. The Morphing Media and Manipulation From Information To...

What is the media in contemporary America? Media is the essential source of information about what is going on in America and the world. The media is where the vast majority of the people receive their information and news. The manipulation of the media can promote the death of freedom in modern America. The media is a great tool for information, but people should not give nearly all of their faith in them. The media evolved from an information channel to an entertainment source. Nearly every single media is revised by some high power such as the government. Most small children are becoming worse due to the influence of the media. Over the years, media has become more manipulative toward their viewers, trying to impose a one sided story in†¦show more content†¦An ethical appeal, or ethos, is where â€Å"writers often try to persuade readers to respect and believe them† (Axel 607). Nearly all of the audience do not tend to know the mass media personally, the media must try to present an image of themselves in their viewing that could gain their audience’s confidence. The media uses this tactic to gain trust in the people. With people’s trust in the hands of the media, lies can be made without the majority of the people realizing. The media is suppose to notify their audience about events going on in the community, not persuade the people in obtaining their faith and reliance. With the media controlling the hope of citizens, freedom can collapse like an old building scheduled for demolition. More than fifty-five percent of the Americans nationwide depend on some type of media for news about what is going on around them. The media has not always been â€Å"entertainment† news, real issues were talked about and informed to the people. In a single large paragraph, the development of the media is described. â€Å"In order to remain afloat, news has shifted to an entertainment mentality as well, often choosing to highlight the lives of celebrities rather than international affairs† (50 Years in Media: Changes in Journalism). Around the 1955, media did not base themselves to entertain people with their news, but rather inform the people. The last five decades has changed the foundation of the media. With new generations

Knowledge of Programming Fundamentals Free Essays

The article â€Å"Future Developments: Tomorrow’s IT Stars Will Need More Than Mere Skills† published in eWeek (2004) likens the science of application development to basic reading and writing skills that all educated people have developed.   This is not to say that all people are today equipped with the knowledge of programming fundamentals.   Rather, the author of the article makes the point that since writing an enterprise application requires a mere set of rules and directions such as those that car drivers are acquainted with, it is possible that every educated person in the near future will be equipped with the knowledge of programming fundamentals. We will write a custom essay sample on Knowledge of Programming Fundamentals or any similar topic only for you Order Now By following a set of rules and directions, therefore, every person who needs to write an enterprise application or software program would be able to find his way.   In that case, what would be the job of trained programmers?   The author describes the programmers of tomorrow as masters in their science.   Like â€Å"master tour guides,† these individuals would be akin to the â€Å"Formula 1 racers who can push their enabling technology to new limits.†Ã‚   So yes, there will be need in the days to come for trained computer scientists.   All the same, today’s programmer must seek to be a master in the science – one who knows more about the technology than laymen who merely follow the guidelines to programming. Given that the layman, too, should be able to follow specific rules to write applications, it is wise to let the computer software be divided into operating systems and applications.   This makes it easier for anyone who is not a master in computer science to easily use both operating systems and applications, each with their own guidelines for operation.   If applications and  operating systems were integrated, the layman would have to learn much more than he would be willing to learn about programming anyhow. Lastly, Coffee (2004) asks if knowledge of programming fundamentals would be required in the same way in the future that reading and writing are taken for granted today as basic skills.   Based on the summary of the article above, the answer to the question is: Yes, every working professional who wishes to follow the set of rules and directions to write his own program in the future would be able to do so almost perfectly.   However, unlike reading and writing skills that are acquired by both working and unemployed people, the skill of writing programs by following a set of guidelines is not expected to be acquired by all people. Spirometry free essay sample

?Spirometry is a diagnostic pulmonary function test. Relatively easy to perform, for both the patient and the clinician, Spirometry testing is noninvasive. The spirometry tests measure lung volumes. There are many reasons spirometry testing is done. Most common would be to assess lung function in disease process, but studies are also done in exercise testing for lung capacity and expenditure of oxygen. Speech Language Pathologists are also concerned with Spirometry testing. The lungs are the power house of speech; therefore in assessing speech disorders, it is necessary to understand lung volumes and their role in speech production. Physicians such as lung specialists, or Pulmonologists, perform lung function studies to assess and diagnose a variety of patient conditions. The most common is COPD, or Chronic Obstructive Pulmonary Disease. According to the National Heart Lung and Blood Institute page, on the NIH website, COPD is 3rd leading cause of death. COPD should be considered with any adult that exhibits shortness of breath. We will write a custom essay sample on Spirometry or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page Other disease processes that Spirometry is useful for: to diagnose and manage asthma, assess impairment in occupational asthma, to differentiate between obstructive and restrictive airway disease, pre-operation assessment for anesthesia administration. Also, spirometry testing is useful to follow lung disease history, and assess response to lung treatments. Pulmonary testing and equipment has seen much technological advancement through centuries, since the first known test of this kind was performed around 200 A. D. , by a Greek physician, Claudius Galen. He used an animal bladder to perform his experiments. Today Spirometry equipment is accurate computerized technology, can be portable, while specialized tests like Plethysmograph, is done inside a closed chamber. The computer software reads the results, records the information on a graph. The apparatus consists of a mouthpiece that the patient will breathe into, connected to a hose that is attached to the computer. Inside the mouthpiece and hose there are sensors that allow the flow of air inhaled and exhaled to be measured. The mouthpiece is disposable for infection control purposes. A nose piece must be utilized; to clamp off the nares and insure that all air inspired or expired is coming through the mouth. Basic spirometry allows the air volume that enters and exits the lungs, along with the rate and force of the exchange to be measured. Normal lung volumes for gender have been established and the test results are compared to these baselines. Before the procedure, basic information about the patient will be assessed, such as height, weight, medical history, and a careful respiratory history, along with respiratory medications. Assessment of medications is important, as some medications will need to be withheld prior to the testing. In other tests, such as the Post Bronchodilator Test, a medication is going to be administered to achieve the results needed. The test is always performed with the patient sitting down, with safety in mind, as the inspiration and forced expiration can cause a patient to faint. Education on test procedure, and why test is being performed is important for the patient prior to testing, because Spirometry relies on patient compliance for complete and accurate results. Also, complete education can prevent typical errors, such as not exhaling to max capacity, taking an extra breathe, or air leak around lips. Spirometry testing is limited to those patients that can understand and follow the instructions, young children that cannot follow the directions, and patients with altered consciousness are unable to perform this type of test. A Speech Language Pathologist will be concerned with client respiratory status in performing assessments for speech and voice disorders. It is important to know when a referral for pulmonary function testing would be necessary, in order to allow the client the most positive outcome with speech and voice therapy. Vital to speech, is the power of the lungs, inspiration and expiration are necessary for the vocal folds to vibrate and produce sound. A clients inability to adequately fill the lungs and will result in poor expiratory quality, affecting the sound produced. A breathy voice or low pitch could be due to lung dysfunction or disease process. Breathing technique can be taught to improve sound quality. Overall health improvement found through diagnosis and treatment of lung disorders can assist the client in voice production. Incentive Spirometry is related to Spirometry testing, loosely. Incentive Spirometry is a breathing exercise tool that can assist the client in gaining more breathing power to improve speech. A simple apparatus, the Incentive Spirometer is a clear plastic device, with an attached hose and mouth piece. The cylindrical body of the Incentive Spirometer is marked with gradient volumes, and a baffle inside moves when air is drawn out, indicating the volume inspired. The process is simple: the mouthpiece is fitted inside the lips, the patient takes a breath in and holds it for several seconds, and then gently releases the breath. This process is repeated several times, generally ever hour or two for the prescribed time period. This exercise can be recommended by the Speech Language Pathologist to assist the patient in building breath quality for speech.

My Mistress Eyes Essays - Literature, Rhyme, Sonnet, Poetry

My Mistress' Eyes Essays - Literature, Rhyme, Sonnet, Poetry My Mistress' Eyes JR BRUNER Lit 100 January 16, 1999 My Mistress' Eyes In this sonnet, Shakespeare seems to be very critical of this woman's physical faults. I tried to approach the poem from a comical view to be able to read it and be comfortable with it. She seems to be of African or Middle Eastern descent by his statement of the color of her eyes and wiry hair. The first line uses the most revealing part of a person's body, the eyes. He claims that her eyes do not compare to the sun, they are dark and cold. She is of dark skin by his reference to her being dun, dark or having brown pigmentation. The second stanza I had a problem with, a person can take it many different ways. One impression I got was she might have had a problem with her diet and just had bad breath. The other was she might have been a shameful hussy. Shakespeare claims that the other perfumes, maybe meaning other women he found to be a lot nicer. While his mistress cusses like a sailor. Shakespeare uses as a model a goddess, whom a person would accept as having perfect physical attributes. His mistress seems to be a very large woman who seems to have problems walking.

'All About Eve 'Film Review Essay Example | Topics and Well Written Essays - 250 words

'All About Eve 'Film Review - Essay Example Although it is not set in the present-day, it does at least take women back to what it was like to be a star on Broadway who is up and coming during a time where the country was on the verge of rebuilding after a war. It is compelling and interesting and shows a relationship between Eve and the woman who is starting to age and see her career start to flail, Margo Channing. Women like to see relationships of other women, especially in show business where only a few women are lucky enough to relate. Since the 1950s were a time when women were starting to gain stronger roles in the household due to it being post-war, this movie is spot on. Eve, who stumbles upon Broadway, could easily be a strong and powerful woman. At this time, women were needed to be breadwinners in a household. Eve could be seen as one of those people as females were starting to finally take off as movie stars in the post-World War II

What about Magnet Status Essay Example | Topics and Well Written Essays - 500 words

What about Magnet Status - Essay Example The Magnet program in hospitals is designed to facilitate nurses and their practices (Wise, 2009, p.g. 205). Magnet hospitals have portrayed structural qualities. These qualities allow the nurses to work efficiently. The magnet hospitals also give nurses a chance to use their knowledge and capability by which they can produce excellent patient care (Havens et al, 1999, p.g. 14). Magnet hospitals have been present since two decades. Various studies have been conducted to study the pros and benefits of magnet hospitals. Results of the studies have proved that superior working environment for nurses at Magnet hospitals is beneficial for patient outcomes. Better working environment leads to higher nurse job satisfaction. Due to these pros, less nurses leave their jobs and are not exhausted. Evidence from studies is indicative that Magnet hospitals should be classified as the â€Å"best practice.† (Kelly et al, 2011, p.g.428). To summarize excellence in nursing has a two-fold benefit as it benefits patients and nurses (Lewis et al, 1998, pg. 51). Studies have shown that finding magnet hospitals these days is quiet difficult since the requirement are more than what a hospital could offer these days. Also, the work schedule required for hospitals to get this status is not possible to be infuse into the environment of the hospital (Pizzi, 2010). Other cons that these facilities get are that they only empower a nurse’s illusion. Acquiring magnet recognition is not easy as it is a procedure that requires labor and time (Magnet Reognition, n.d). Magnet status is a term that has been circulating in the health care industry for over two decades now. Health care facilities which provide autonomy, distributed organizational structures, helpful management and self-governance to the nursing staff are given the â€Å"magnet† status. Patients admitted at magnet status hospitals have a better mortality

Discuss the reasons that France was ripe for a Revolution in the years Essay

Discuss the reasons that France was ripe for a Revolution in the years leading up to 1789. Include a discussion of Sieyes''What is the 3rd Estate '' and the Cah - Essay Example It was under the motivation, guidance and inspiration of the bourgeois that the French revolution took place. There have been a lot of debates and discussions as to what led to the French revolution. Critics vary in their analysis of the true cause behind the revolution. According to Hunt (p 5), the middle-class intellectuals were the masterminds of the revolutionary plot as this particular social class was economically well-off, socially aware and educationally advanced. The bourgeoisies were against feudalism and absolutism and stood for democracy. Furet is of the opinion that one of the many reasons of the French Revolution was a change in the mindset of people for a newer and liberal kind of political establishment. On one hand the increasing exploitation of the third Estate with the drainage of the royal treasury spent on mindless luxury of the nobility, levying heavy taxes on common people at whim and on the other the coming into sense and socio-economic status of the bourgeois were reasons for the mass outburst. Moreover, it was a revolution where women too played significant roles a s the social status of women was as good as nothing (Levy et al). There was a demand for the declaration of the rights of man that was behind the radical decision to storm Bastille in 1789 (Hunt et al p 653, Lualdi p 50-52). However, there was no attempt to reform the older policies to uplift the general scenario of the ailing land and its people. Joseph Sieyes has provided a vivid and detailed description of the function and potential of the third Estate thereby nullifying any requirement or presence of the other two Estates that of the King and the Church. He has defined his own class system that is not based on the paradoxical concept of hierarchy but on an innovative concept of work sequence. According to him peasants should ideally belong to the first class because agriculture is the basis of any nation. Next he puts the workers

Marco Polo The Travels

Marco Polo The Travels Marco Polo is inarguably the most famous medieval European traveler, despite the heated controversy among modern scholars surrounding his adventurous travels. In The Travels of Marco Polo, Polo has clearly portrayed the character of the 13th century Asian society, which forms the basis of this paper. Various issues have been considered in the paper, such as the government organization and administration by Kublai Khan, the prosperity of the Asian society, their beliefs and last but not least, the values and possessions that people esteemed. At the age of only 17 years old, Marco Polo accompanied his father and uncle in a long and difficult journey from Venice his birth place, to Cathay, China. It was in this journey, started at the end of 1271, that Marco began his account of the escapades during the three and a half long difficult journey, and his account of the Mongols life. Marcos detailed description on the greatest moment when he first met the Great Khan, and the appointment of Marco to high posts in the Khans administration demonstrated Marcos gift in linguistics and languages. His amazement with Chinas vast power, immense wealth, and complex social structure made Marco to travel the more in China, becoming one of the most travelled Westerners on the Silk Road. His journey throughout Asia took 24 years, which made him to reach beyond Mongolia to China (Silkroad 10-14). The following analysis is based upon Polos information, and additional information obtained with reference to his writing. The government of the 13th century Asian Civilization provides an interesting reading, especially from the ruler, Kublai Khan. Kublai Khan was, as Polo describes him, the â€Å"the greater and more powerful than all others†, of the six khans that ruled the Mongol Empire. Being the last khan, a title given to a ruler in the Mongolian languages, Kublai ruled the Mongol Empire from 1260 to 1294, founding the Yuan Dynasty, which lasted until 1368. The Mongols, under the rule of Kublai, implemented divide-and-rule methods in a way that made the Mongols and the Asians to remain separate from Chinese life (Brummett et al 98). By dividing the Chinese population into the Mongols; the northern Chinese and Koreans; the southern Chinese; and the central Asians, it was possible to successfully rule the Mongol minority. While the Mongols and the central Asians enjoyed extensive privileges the southern Chinese were barred from state offices. The government was also reorganized by Kublai, and he established three distinct divisions to supervise the military, to deal with civilian affairs, and the third one to supervise the major officials (EWB 6-10). The prosperity of the Asian society during Marco Polos travels is revealed by many of Polos quotations concerning, for instance, the Greater Hermenia. Polo wrote that the Tartars of the Levant frequented the Armenian country every summer due to the outstanding pasture that was available in plenty for their cattle. The pastures were always abundant for the cattle, and according to Polo, the pastures were in large quantity, never failing the cattle. Also of unique significance is the oil fountain that Polo met on the boundaries towards Georgiana. The plenty oil that sprung from the fountain was in such a large quantity that as Polo put it, â€Å"a hundred shiploads might be taken from it at one time.† Although the oil is was not recommended to be used with food, it was needed for burning and was also used for anointing camels that had the mange. The oil was such a treasure that people came from great distances to obtain it (Armenia ch5). The beliefs of the Asian civilization are of utmost importance when understanding their character. There were various beliefs in the 13th century Asian society, and the existence of the different religious beliefs, for instance, was because of Kublai Khans religious tolerance. Moreover, Kublai supported Confucian rituals and rites at court, and also showed special act of kindness to Buddhism. His tolerance was further demonstrated by his decision not to alienate Daoist interests, as well as protecting Muslims and professing an interest in Christian beliefs (Polo 134). The monastery of St. Barsamo is a very important example in portraying part of the beliefs of the 13th century Asian society. The many monks who came to the monastery involved themselves in knitting girdles, which they placed on the altar of the monastery as the service continued. The monks have been likened to the â€Å"Brethren of the Holy Spirit† Polo, and he writes that they present the girdles to their friends and to other people, since the monks belief was that the girdles could remove bodily pain. Every monk, henceforth, just like the â€Å"Brethren† is religiously fervent to have them. Polos description of how the one-eyed man prayer caused the mountain to move is very significant in understanding the Christians and their behaviors, as they converted the Saracens after the miracle had been performed (Armenia, Ch12) Polos travels reveal various possessions that people esteemed. One of these was the manufactures promoted under the Mongols. The Mongols were good stewards at accumulating wealth, which they did through various ways, such as sacking of cities, promoting trade, and by taxation. A variety of objects were found in the tombs of the influential Mongolians, especially from the 13th and 14th centuries. These included items such as gold cups, leggings, robes. Of these commodities, hundreds of craftsmen were located into northern China, others located in the steppe regions north of the Yellow River. Marco Polo described them as â€Å"they live by commerce and industry†¦just as we have woolen clothes of many different types, so have they of cloth of gold and silk† (Waugh 34). Marco Polos narrative was of tremendous use in understanding the 13th Century Asian civilization. From all the discoveries that he made, and all the documented information regarding the behaviors, culture, and way of life of the Asian community, it was possible for one to not only understand the civilization, but also appreciate the lifestyle. There were numerous adventures in Marco Polos travels, which played an important role in understanding various elements of the character of the civilization. Marcos escapades were written with a simple, yet profound, easy to understand way, and his excellent skill of using an interactive language was very significant in relating with the society. Since most of the information provided in Polos narration was concerning his experiences and the Asians way of life, the narration was a very relevant source in understanding and characterizing the society. The Chi Omega Greek Theater and The Theater of Dionysus :: Architecture Compare contrast Essays

The Chi Omega Greek Theater and The Theater of Dionysus The Chi Omega Greek Theater was constructed as a gift to the University commemorating Chi Omega's founding in 1895. It is the only United States structure of its kind and it was designed to be almost a replica of the theater of Dionysus at the Acropolis. The theater is used on the campus today for plays, pep rallies, and meetings. It is accessible to students, faculty, members of the community and acts as a constant reminder of the Greek System's support of the school. The Greek Theater is not well known throughout the country, however it is a site of pride in Fayetteville. It stands for both the unity within the sorority and the monument to the goddess Demeter who supported civilized life. The first use of the theater was in 1930, when a play was performed telling the story of Demeter and Persephone. The theater of Dionysus stands at the foot of the acropolis and its date originates back to the 6th Century, B.C.. Its originally wood seats rise in tiers above one another against the slope of the acropolis, creating a natural setting for the plays (D'ooge, 231). The Greek Theater was built to house a drama which, during the festivals of Dionysus, had evolved from the long tradition of choral hymns which were presented each year. As Greek culture changed and flourished, entertainment transformed from being a series of choral chanting and dancing to placing an emphasis on the actor. As the actors' importance grew, there became a need for a stage from which they could be seen by each of the fourteen thousand spectators the theater housed. The chorus was still a very active part of the entertainment and they resided in the orchestra (Norwich, 64). The orchestra was the oldest part of the Greek theater and thus, when the actor was given more emphasis, the chorus was still regarded very highly.

All About Eve

Ironically, we see the story repeating Itself at the end of the film. The story itself reflects a history that is as old as show business. Betty Davis' plays Margo Changing, the star of the film fears her stardom will soon fade do to her turning 40 years of age. Margo goes through a series of events were she panics do to her aging. In reality being the age of 40 is not very old. However, in film business actresses are unable to play various roles. Ideally, most roles are created for pretty young woman, and after a certain age it is difficult to portray those oleos.Males however, are able to continue their advancing years In many roles. Marco's character Is egoistical, very demanding, and obsessed with stardom's. Her life revolves around theater. The numbers of roles that are offered to her are suddenly decreasing. Although her character shows confidence on the outside, in the inside she is full of insecurities. Betty Davis' was the perfect candidate for this role. Davis' herself was a very famous Hollywood star whose career was going down the drain due to aging. This movie put this aging actress back to the top.Ann Baxter plays the role of Eve. This character plays a role of a star struck fan. At first Eve seems to be a very naive, and sweet. Eve Is dressed down at the beginning in an old trench coat and hat. She Is setting herself up for an Improvising soul who has to pay cheap for a ticket at a standing room; giving the illusion that she is caught up with the love of the theater. She soon becomes Marco's assistant, and then understudy. Both actresses convey their roles in such a natural way that it seems as if the roles were written for them.Actuality, there was other actresses who were noninsured for these roles, but the castings prevailed. In the film, Eve becomes Marco's understudy with the help, and Influences of great theater people. The film portrayed the rivalry and competition between actors. The movie was such a success that it was nominated for many awards. This film put Betty Davis back on top. Her great performance got Betty nominated In the academy awards for best actress. But, her co-star Ann Baxter (Eve) insisted on being nominated for the same award.Rather than taking the award for supporting actress. This caused the votes for tooth actresses to cancel out; therefore, giving the award to the runner up. Eve later admitted her mistake In not accepting the supporting actress award. George Candler's plays a theater critic named Addison De Witt. De Wit's character is very egoistic, snobby, and believes he is the most important person in the theater world. His dialogue consists of sarcastic tones that set the films themes in perspective. His character represents the views of the director Amanuensis. In a theater community a well recognized critic can make a difference in an audience. Monger than Margo. Yet, he falls in love with Margo and marries her. In real life, Merrill did fall in love with Davis, and also decided to marry her. Along with the cast of this great film Marilyn Monroe is introduced. Marilyn plays the role of Miss Caldwell. Miss Caldwell is interested in meeting wealthy men, and therefore uses her assets like her body to attract them. In real life Marilyn did use her assets to accomplish her goals. The films dialogue sets the movie apart from any other film. The characters are always lively, and clever. Their tone of delivering their lines makes the audience stop and pay attention. The films dialogue undertones all the hidden feelings that the characters are establishing. It reflects the backstabbing, and the means people will take in order to reach stardom. The film director uses high key lighting in black and white in order to portray a flawless and glamorous look. This gives the image a clear and clean appearance. This choice of lighting smooth's the characters flaws, and makes them appear younger than they are almost doll like.In the film the people that are involved in theater appear t o be very wealthy. The characters are dressed formal, and glamorous. It appears that the world the characters inhabit is white segregated. The characters all obtain fur coats, and they appear to treat them as if they had no value. Birdie (the helper of Margo) makes Jokes of the bed looking like a dead animal when the coats are thrown on the bed. Small items like these indicate wealthiest. The film â€Å"All about Eve† is a great representation of the behind the scenes of a theatre based environment. The film represent the secret feelings, envy, Jealousy, and backstabbing between friends, and colleges. This film is an insightful manipulation of art imitating life. The clever dialogue and sharp performances illustrate the plot of the story. The audience is introduced to the story of a young lady and her ruthless way to rise in fame. Once she is an inspiring actress, we see the story repeat itself as a young lady enters the life of Eve claiming to be a star struck fan. The cycle repeats itself, and there are many women who are ready to take her spot.

Critical Thinking Application Paper

Critical Thinking Application Paper All people make decisions when they are faced with situations that require decisive solutions. Large companies and organizations depend on the decisions made in achieving their goals and objectives. Decision making process involves the use of critical thinking when a situation arises. Critical thinking is defined as the ability of thinking in a rational and clear manner. The process of critical thinking ensures that conscious decisions are made (Lutchman, 2010). The application of critical thinking is in some situations is able to make the thinker make effective decision. Decisions are made using gathered information that relates to the problem (Lutchman, 2010). These are critically analyzed and through different assessment a decision is arrived at in solving a situation. Marquis and Huston (2009) notes that critical thinking is also called reflective thinking that uses evaluation; this makes it broader than problem solving and decision making processes. According to Lutchman (2010) critical thinking is a behavior that is learned and enables the thinker make conclusions based on the information but not the obstacles that may arise. The evaluation critical thinking paper gives an example that required critical thinking as well as the importance and benefits of critical thinking in decision making process. After closing the college during the summer holidays I had an internship program with one of grocery chains stores. I was placed as an assistant supervisor in charge of the customers care department. I had to report all the complaints brought forward to the supervisor or the manager if supervisor was not available. The decision I would make would be taken seriously and applied. I received a complaint from one o f the customers that one of the employee’s was rude and unethical. This was a serious offence in the company and any employee who broke it was either fired or suspended from work. After getting the full details of the complaint, it was evident that the employee had used words that portrayed racial discrimination. The worst part of it was that the employee was my classmate and a close friend. Decision had to be made on this indecency behavior that had violated the company’s policy and even the federal law. Racial segregation is a federal crime in the United States of America and racial profiling is not acceptable. Advertising Looking for essay on business economics? Let's see if we can help you! So decision that required critical thinking had to be given in the next 24 hours. The fate of the e mployee depended on my decisions. The company didn’t want to loose a dependable employee, so did I not want to disappoint and lose a friend. Different viewpoints and scenarios of dealing with the matter were evaluated. At the end of the day two options on the decisions to be made remained, to either fire the employee or to suspend the employee and transfer him to another store. This was the hardest point to make a decision but through critical thinking a verdict that served the employee appropriately was achieved. The decision was not influenced by any external factor like friendship or influence of the company. The decision making process is made of several stages that are interrelated. For decisions making process to be complete critical thinking process is applied. The importance of critical thinking in decision making process is that it allows individuals make appropriate judgments (Lyer, Levin, Shea Ashton 2006). Judgments make a positive decision making process that m ay have an impact on the general welfare of an organization. For example, in the hospitals the assessment of patients is based on critical thinking of nurses. According to Lyer et al (2006) critical thinking helps in alleviating errors during the decision making process. For example, the Toyota Company uses critical thinking in deciding the stability of a car. This is to avoid errors that may affect the customers and its credibility. Through critical thinking decisions errors are avoided and minimized. Because critical thinking involves the use problem solving process and behavior that evaluates collected information or data. This aids in the decision making process because it forms the basis of the whole process. Iyer, Levin, Shea and Ashton (2006) notes that the benefits of critical thinking is that it helps in setting priorities, making inferences’ as well as constructing effective plan that can be followed in decision making process. Critical thinking helps in enhancing the thinking process where an individual becomes acquainted to the critical thinking (Marquis Huston2009). This enables to automatically respond to critical thinking when a problem is triggered. Lutchman (2010) notes that critical thinking gives the right conclusions on a particular issue from set of given information. After developing the skills a critical thinker can never be swayed away by emotions, or any other obstacle. The process of critical thinking acts as motivating agent in encouraging people to become better critical thinkers (Lutchman, 2010).Advertising We will write a custom essay sample on Critical Thinking Application Paper specifically for you for only $16.05 $11/page Learn More In conclusion, critical thinking involves a learned process of evaluating a situation based on given information. It is used in decision making process and its importance is that it helps in solving problems. It also helps decision makers make right judgments and avoid unnecessary errors. The major benefit is that it helps in developing skills and motivates a critical thinker to become better. Reference List Lutchman, C. (2010). Essay on Sustainable Development of Environment Essays

Essay on Sustainable Development of Environment Essays Essay on Sustainable Development of Environment Paper Essay on Sustainable Development of Environment Paper Essay Topic: Renewable energy According to WEEK sustainable development means a process of hang in which the exploitation of resources, the direction of investments, the orientation of technological development and institutional change are all in harmony and enhance both current and future potentiality to meet human needs and aspirations. Sustainable development is a development that meets needs of the present without compromising the ability of future generations to meet their own needs. For achieving sustainable development what is needed in global movement as well as significantly increased political will and public pressure in order to persuade industry, governments and institutions to take responsibility for their action. It must be borne in mind that development should not endanger the natural system that supports life on earth. With this attitude towards nature technological advances increase our ability to use earth resources and thus increase the damage. However, the realization is growing fast that we are in a world of limits and ever increasing growth of material consumption can only damage the life giving physical components of the environment. The concept of sustainable development was highly appreciated at the United Nations Conference on Environment and Development (OUNCE) at a ROI De Jeanne in Brazil, commonly known as Earths Summit. Sustainable development also needs understanding the basic needs of deprived people of the world. It is necessary to provide opportunities in order to satisfy their aspirations for a better and secured life. Sustainable development can be successfully achieved by (l) conservation or reduction of excessive resource use (II) recycling and reuse of materials and Ill) more use of renewable resources like solar energy, rather than non renewable resources such as oil and coal. The sustainability of development is initially linked to the dynamics of growth of population. The failure of family planning programmer has been the principal reason for Indians continuing backwardness. It is thus essentially needed to adopt a rational, welfare oriented human approach to family planning in order to achieve the goals of sustainable development. In this respect the developed countries have supranational impact on the global environment compared to developing countries. Besides, industry has always been the primary cause of economic development. Needless to mention that without adequate environmental protection development cannot be achieved to the extend which we require. The kinds of industries that grow fast determine the severity of pressure on natural resources and consequent environmental problems. Apart from industries involvement, global warming stands in the way of sustainable development. The primary cause of global warming is the green house gases. The generation of excessive amount of green house gases by developed countries is a matter of serious concern. The climatic changes induced by green house gases effects agriculture, and other fields including forestry. It must be released that development at the cost of greenery and ecology, cannot be called as sustainable development. Over exploitation of natural resources, deforestation and the extensive use of chemical fertilizers and pesticides in agriculture have resulted many changes in the different components of environment. In this respect it is always desirable to use environment friendly products on controlling agricultural pollution towards sustainable developments. Pesticides are considered as biological control agents like bacteria, fungi and insects which work for pest control in plants. Industrial revolution has led to the development of cities where population has been increased due to what is known as arbitration. The population grog. VT in the cities has led to acute shortage of clean environment. The arbitration adds to air, water and noise pollution to a greater extent.

Is there equity in Out of Hours Services for Palliative patients in Essay

Is there equity in Out of Hours Services for Palliative patients in the community setting - Essay Example of an area, age of the patient, whether the patient has a primary diagnosis of cancer versus non cancer, whether the area is one of high social deprivation and if there are local trust financial constraints which necessarily have an impact on the services available. Equity in palliative care is a major issue facing England. This paper shall explore the various reasons to the equal or unequal access to palliative services which might be dependent on geography and road infrastructure of an area, age of the patient, whether the patient has a primary diagnosis of cancer versus non cancer, whether the area is one of high social deprivation and/or if there are local trust financial constraints which necessarily have an impact on the services available. Death is never a simple matter. Yet, while hospice and palliative care attention to end-of-life (EOL) care has benefited the general population, people with unequal palliative healthcare access and their families have not benefited from the same extent of end-of-life attention. Modern medical and nursing care have contributed to lengthening the life span of people with unequal access to palliative services because of geography and road infrastructure of the area, age of the patient, patient’s primary diagnosis of cancer or non cancer and the area of high social deprivation and low financial support so that previously fatal, acute illnesses and complications from their disabilities are now managed by artificial life support measures such as dialysis, gastrostomy, nephrostomy, or tracheotomy. As life expectancy lengthens for this special population, they ultimately face the same chronic and terminal illnesses as the general population and, consequently, the same decisions exist. Unfortunately, however, because of cognitive impairment frequently associated with people having various issues with palliative care access and individuals, family members must often serve as their proxies in EOL care decision making. Ratios Essay Example | Topics and Well Written Essays - 750 words

Ratios - Essay Example The ratio analysis will consist of a combination of ratios from three categories. The three ratio categories are profitability, efficiency, and leverage ratios. Three profitability ratios selected for the analysis are net margin, return on equity (ROE), and return on sales (ROA). The three efficiency ratios used in the ratio analysis are sales to inventory, assets to sales, and sales to net working capital ratio. The two leverage ratios selected were debt ratio and the current ratio. Appendix A shows the ratio calculations results for Target in 2009 and 2008 and for comparison purposes the ratios of Costco in 2010. The net margin shows the profitability of the firm by dividing net income by sales. High net margins are a desirable outcome. The return on equity shows how much profits are being created in relation to its equity investment. The return of assets shows how much of a return a company is obtaining from its assets. High ROA and ROE are desirable outcomes. The sales to invento ry ratio shows how well your inventory is producing sales. The asset to sale ratio shows the ability of the assets to generate revenue. The sale to working capital ratio is calculated dividing sales by net working capital. In fiscal year 2009 which ended on January 30, 2010 Target generated revenues of $63435 million (Annual Report: Tesco, 2009). This figure represents an increase in revenues of 0.88%. In 2009 Target had a net margin of 3.92%. The firm was able to increase its overall profitability by 0.40% in comparison with 2008. In order to compare the ratios of the company with a competitor we choose Cotsco. The most recent financial statements of Cotsco were released in fiscal year 2010 which ends on August 29, 2010. The net margin of Cotsco in fiscal year 2010 was 1.67% (Annual Report: Cotsco, 2010). The net margin of Target is better than Cotsco by 2.25%. The return on assets of Target in 2009 was 5.14%. This metric improved by 0.12% in comparison with the previous fiscal yea r. The return on assets of Target is inferior to Costco by 0.33%.The return on equity of Target in 2009 was 16.21%. The ROE of Target is superior to Cotsco by 4.29%. The sale to inventory ratio of Target in 2009 was 8.84. The financial metric was reduced by 0.54. The sale to inventory of Cotsco in 2010 was 13.83. Cotsco had a superior sale to inventory efficiency by 4.99. The asset to sale ratio of Target in 2009 was 0.70. Cotsco had assets to sales ratio of 0.31. The asset to sales ratio of Target was superior by 0.39. The sale to working capital ratio of Target in 2009 was 8.93. The sale to working capital ratio of Cotsco was much better at 47.38. The metric of Cotsco was superior by 38.45. The debt ratio of Target in 2009 was 1.53. Due to the fact that the company has a debt ratio above 1.0 it is in a favorable position to pay off its long term debt. The debt ratio of Cotsco was better at 1.85. The current ratio of Target in 2009 was 1.63 which is 0.03 better than in 2008. The fi rm is a good position to pay off its short term debt because the current ratio is above 1.0. The current ratio of Target is better than Cotsco by 0.47. The operating expenses of Target in 2009 were $13,078 million which represents an increase in operating expenses of 0.42%. The financial ratio analysis performed on Target led me to believe that Target is a good acquisition for the company. Target had excellent revenues and profitability numbers. The 3.92% net margin of the firm is better

Technology in diplomacy Research Paper Example | Topics and Well Written Essays - 2000 words

Technology in diplomacy - Research Paper Example This has resulted in Austria shifting to paperless records, during late 1990s, while MFA of Latvia was awarded for the best web-site in 2003.(â€Å"Information and Communications Technology† 193) Foreign ministries around the world are still struggling to engage the benefits of information technology in their management of external affairs. However, some of the countries have realized the potential of using â€Å"Web 2.0†. A good example in this direction is Denmark, which has created a â€Å"virtual working group†. The function of the group is to arrange meetings of all members, from all corners of the world, using video-conferencing. This way the working group has better coordination; as it has members from all units, which are relevant to the working of country’s MFA, along with its branches in Africa, America, UN and EU countries. Utilizing the full potential of information communications technology (ICT), Denmark has identified the five principals of E-management, mainly applicable to a MFA manager. These include usage of intranet, on daily basis, for sharing ideas and communication. The concerned manager is required to make use of best practices, using IT tools, to set an example for the staff. In addition, the manager must ensure that the staff members are fully familiar with information technology, having the required skills. The manager is required, personally, to be fully conversant with the E-Government Strategy of MFA; while understanding its contents, perfectly well, which would help in contributing to the policy guidelines, in a positive manner. Canada, being the other country, which is utilizing the full potential of ICT, started an e-exercise, called ‘Public Diplomacy Network’, which involves offering of suggestions and other tips to the government on its foreign affairs policy. Accordingly, public awareness has been created among the people, through this network, regarding the government policies on inte rnational issues. Mexico is yet another country, which has growing network of foreign consular posts, in United States, sharing the best consular practices, while mutually learning, through the foreign ministry’s intranet. (â€Å"Information and Communications Technology† 194-5) With the rapid developments in the field of ICT, it is essential that all concerned keep pace with same, while understanding the changes, in a positive manner; which can help solving the problems, almost instantaneously. The social network sites, like face-book, have set an example for others, regarding best use of ICT. ICT applications After the use of computers as simple machines, their versatility increased with use of ‘local area network’ (LAN), which made inter-connections possible. Hence, many MFAs are using this technology even now, to stay connected. Then came the use of ‘wide area network’ (WAN), which meant keeping different ministries and departments of a co untry connected. Most European countries have adapted to this technology, in 1990s. However, many are still hesitating to use it, as they fair leakage of sensitive data, particularly pertaining to their MFAs. ‘Virtual private network’, or intranet, has been used to cover all the embassies of a country, as it widens the scope of WAN. However, many smaller countries are not able to go for such technology, due cost and skilled manpower constrains. Countries like China, Japan and India have

Identify Unnecessary Services from a Saved Vulnerability Essay Example for Free

Identify Unnecessary Services from a Saved Vulnerability Essay Nmap/Zenman is an application that allows users to scan networks to see what ports and services are open. It can be used by network security to find holes in their networks and plan what to do with them or it can be used by hackers to scan other networks to get a clear look at a networks topology and map out where everything is and plan for an attack. In this case, we have a scan of our network at Corporation Techs and need to look at what services that we have and make a decision on whether or not we should keep or get rid of them. According to the scan we have, we have a bunch of difference services that we use. Simple Mail Transfer Protocol (SMTP) is how our employees sent their mail. Post Office Protocol (POP) is the services on how we receive them. These are both important in any business so they could send and receive messages so I would not recommend closing them. As I look through more services that we have on our network, I notice that we have Sophos installed on our app server. Sophos is a company that works in anti-virus software. They been in business for a few years and to my knowledge they do a good job. However in this case we have enough anti-virus software and our network is very stable. Matter of fact, the scan also shows that we have other IDS and other services that will protect this network. I believe that Sophos is a good service but it is unnecessary at this time so I would suggest removing this. My plan for removing unnecessary services is simple. Go though our network to see we have and have not been using and make a list of services that are necessary to keep this network working. Any services that do not make the cut, gets cut.

Career: Career includes sequences of positions, jobs or occupations, which a person has over his/her working life. Terms that are defined above are mainly considered while doing job analysis. Job analysis methods There are some methods which a manager use to determine job elements, knowledge, skills and abilities are required to perform certain job. In several cases, workers would not be able to perform or function most efficiently while they are being directly watched at their work. Therefore job analyst may find some distortion in this method. In some jobs it is possible to watch an employee on their job but in certain jobs it is not possible to watch e.g. in most of managerial jobs it is hard to watch entire activity. Individual interview methods: In this method, the person who is responsible for the jobs are selected and extensively interviewed by the job analyst. In results, these interviews are combined for a single job. This method gives high an effective way for assessing what a job entails or what a job requires. But this method is very time consuming. It takes so much to interview individuals and gather information which is needed for the job. Group interview method: This method is also similar as individual interview method the only difference is the number of incumbent are two or more than two. It is also an effective method to collect information regarding a particular job. In this method accuracy is increased in assessing jobs, but group dynamics may hinder its effectiveness. Structured questionnaire method: In this kind of method, job analyst send a structured questionnaire to the worker, in which they check or rate items they perform on their job from a long list of possible task items. Questions which are send seems to be a kind of checklist information that is presented in front of the workers and have to response from the questions that are mentions in the questionnaire. This method gives job analyst a technique which is found as an excellent source of gathering information about jobs. It has been also discover that exception to a job may be overlooked and feedback is often lacking. Technical conference method: In this method, supervisors with extensive knowledge are gathered. This method utilizes supervisors with high knowledge. This method is used to get specific characteristics of a job are obtain from the experts. Person who are consider as experts are being invite in this method. It is a good way of gathering data. It is found that this technique often overlooks the incumbent workers perception and their thinking regarding what they are doing in their job. Dairy or log method: In this method, job incumbents are being asked to record their daily activities. It provides a lot of information but it is rarely applicable to job activities. This method is one of the forcing ways to get information. It requires lots of work to be done from the incumbent and thats why it needs more time. If the job analyst want to capture information in the entire range of work activities, this method have to continue from a long period of time. All these six methods are not meant to be viewed as mutually exclusive. Many organizations have different kind of positions; it may vary from skilled to non skilled employees positions. The analysis may use different methods of data collection for different positions. Here job analyst may make a combination of all method or some of the selective method. Some times worker find it difficult to complete an open ended written questionnaire and this may not gives the information which analyst requires. As an alternative interviews and observation might be more appropriate data collection technique. For selection, some pre employment tests are also taken by human resources management department and to identify these tests job analysis is one of the important way. Developing compensation systems: Compensation is typically related to the requirement of the job, such as education, skills and experience needed to perform the job, employees working conditions. Here job analysis provides a standard way to distinguish process to determine pay and other benefits to the workers across the organization. It provides compensation to the employees on the basis of common understanding of the values of job and requirement of the job to perform it. Human resources planning, career development and training: With the help of job analysis, employer can identify the need to training and development for every individual position in the organization. There are some internal and external changes which forces organization to restructure and rearrange activities in work. Job analysis provides certain information of the changes in workplace, which an organization has to, identifies and has to accommodate that change. Factors affecting Job Analysis program To design a job analysis program, job analyst has to consider the factor influencing it. The analyst has to work with the representatives of the organization to determine the most effective methods and procedures for collecting information. It is important for the job analyst to understand who organization operates. Job analyst has to find out best time to obtain information from the incumbent and supervisors. Jobs are not done with the same intensity of the work. Following are some of the factors influencing job analysis program. Location and number of incumbent: One of the factors which job analyst has to consider while doing job analysis is location of incumbent and number of incumbents. Many organizations have several different units and that units are located in different areas. If a job analyst wants to meet incumbents to get information about their work and that unit where incumbents works is for away from main branch of organization, than it is difficult for job analyst to do it on time job analyst have to plan if earlier. It is also time consuming. Some time it takes too many times to reach incumbent just to get few information on the job. Many times there are many incumbents have to be interviewed. They all are not easily available on the same time so to meet them job analysis have to spend lots of time to collect data for the relevant sources. Location and number of incumbents are one of the most influencing factors which a job analyst has to consider for job analysis process. Location of the organi zation is closer from the place where analyst is, then it is most convenient to reach incumbents and finish analysis in planned time, but it is far away, than it will became time consuming and cost effective. Some thing with the number of incumbents, if there is large number of incumbents to be interviewed than analyst has to figure out how to reach them at a time and when they all are not available on time than it will became difficult but if all of them are available in same time then it became easier for the job analyst to interview them and collection data and information. Work condition/ environment: This is another factor which job analyst has to consider while doing job analysis. In many situation job analyst have to approach those incumbents who are working in very hazardous condition, Incumbents are operating some heavy machinery, that take long time to shutdown and take long time to start, work condition is on influencing factor which job analyst has to consider while doing job analysts. There are many organization where employees have to wear mask to protect themselves against hazardous chemical coming out from the production. In such situation analyst has to wait till the process is order and incumbent is free to talk has to wait till the process is over and incumbent is free to talk with analyst. Here analyst may has to spent time more than what it was planned. If incumbent is working in very noisy condition and cant answer the questions of analyst, then again it is wastage of time for analyst. Analyst has to consider that in what kind of work ing condition incumbent is working, so that analyst can plan his/ her meeting with incumbent and save the time of job analysis process. Knowledge, technology, and personal factors: There is one more factor which is influencing job analysis program and if is knowledge of incumbent, technology which is being used at working area and technology which organization wants to implement, and personal attitude, behavior belief regarding the job which incumbent is doing, sometimes incumbent has a sound knowledge about what analyst is looking for, but when incumbent does not have much knowledge about the job and analyst has to interview him/his at this time analyst will not get relevant answers or data which can be useful for job analysis. If affect job analysis process. technology is one and when analyst has to approach incumbent who is working with old technology.
